Affiliate Agreement

Affiliate Definition
This agreement outlines the full terms and conditions for participating in our Affiliate Program. By signing up, you agree to adhere to these terms. “Affiliate” refers to you, the applicant. The terms “you” or “your” refer to the Affiliate, while “we,” “our,” or “us” refer to Our Company.

Affiliate Site
Upon completing the Affiliate Enrollment Form, a unique URL will be generated for you to use as your Affiliate Site.

Commissions
As an affiliate, you will earn a 30% commission on the revenue generated from orders placed through your Affiliate Site. The commission rate increases to 50% for 51-100 sales per month and 70% for 101+ sales per month. Commissions are calculated after deducting charges outlined in this Affiliate Agreement. To earn a commission, the customer must complete the order form and make full payment. Commissions will only be paid on sales made through qualified Affiliate links.

Payment
Payments will be processed by Click2Sell in accordance with their policies. Commissions will be sent via check. If any orders that generated a referral fee are returned, or if there are any returned checks or chargebacks, Click2Sell will deduct the amount from your next payment.

Order Fulfillment
Our Company is responsible for processing all orders placed on your Affiliate Site. You are not authorized to resell these products or claim resale rights unless explicitly stated.

Customers
Customers who purchase products through the Affiliate Program will be considered customers of Our Company. As such, all of our rules, policies, and operating procedures regarding customer orders and services will apply. Prices and availability may vary, and our policies will always determine the price paid by the customer.

Qualifying Sites
Our Company reserves the right to reject any site from participating in the Affiliate Program based on its content. Sites that do not qualify include those that:

• Promote sexually explicit materials
• Promote violence
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• Promote illegal activities
• Violate intellectual property rights

Unsolicited Commercial Email (SPAM)
Our Company strictly prohibits mass unsolicited emailing (spamming). Affiliates must adhere to this policy or face immediate termination from the Affiliate Program without refunds. Violators will be reported to the FTC and other relevant authorities, potentially facing severe criminal and legal penalties.

Relationship of Parties
You and Our Company are independent contractors. This agreement does not create any partnership, joint venture, agency, franchise, sales representative, or employment relationship. You have no authority to make or accept offers or representations on our behalf.

Limitation of Liability
Our Company will not be liable for any indirect, special, or consequential damages (including loss of revenue, profits, or data) related to this agreement or the Affiliate Program. Our total liability will not exceed the total commissions paid to you under this agreement.

Intellectual Property
Our Company is a trademarked name, and you have no rights to use this name for any purpose without permission. You must ensure that all content on your website does not infringe on any third-party intellectual property rights. You agree to indemnify and hold us harmless from any claims of intellectual property infringement.

All actions taken by you must be in accordance with prudent business practices and comply with all applicable laws and regulations. All information obtained from Our Company is our sole and exclusive property.
